TERMS AND CONDITIONS OF USE



1. ACCEPTANCE OF TERMS AND CONDITIONS

The presents constitute an agreement between the user of the site (the "Site") and Staffnight Canada Inc. ("Staffnight") with regard to the Site.

PLEASE READ THE TERMS AND CONDITIONS SET FORTH BELOW CAREFULLY BEFORE ANY NAVIGATING INSIDE THE SITE.

In navigating inside the Site, you agree to be bound by the terms and conditions of the presents in accordance with the applicable laws.

IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, KINDLY LEAVE THE SITE IMMEDIATELY.

These terms and conditions may be modified by Staffnight from time to time in its sole discretion and they shall become in force automatically. So, please, return to the terms and conditions from time to time to review them.



2. SERVICES PROVIDED

The Site gives to the candidates seeking a job in a bar, club, tavern, pub, night-club or other after-hour place, the ability to consult a bank of job offers and to the employers to access a large bank of candidates’ profiles.



3. USE RESERVED TO ADULTS

By virtue of the laws applicable to the kind of offered jobs, any candidate must have legal age. Legal age may vary from a province to another. At time of registration, we specifically request the candidate to declare his (her) date of birth and other personal information which is objectively requested by the kind of offered jobs and directly related to the ability to perform the tasks of the job. In using the Site, the candidate declares to have the required age and therefore, Staffnight cannot be held responsible for any consequence of false representation made by the candidate relating to his (her) age.



4. PROHIBITED USE

The mission of the Site is to unite candidates with potential employers. Any other use of the Site is strictly forbidden. This includes the following prohibited uses:

  • Posting of nonexistent job vacancies or positions with incomplete, misleading or erroneous descriptions;
  • use of the Site other than to recruit or be recruited for employment (e.g. disguised commercial advertising);
  • data mining for business or advertising purposes including actions aimed at increasing the number of visitors of another Web site;
  • the sending or forwarding of any studies, contests, advertising for pyramid selling schemes, chain letters or other unsolicited materials (spamming), piracy (hacking) and any other illicit or illegal act.

Staffnight reserves the right to stop activation of the user’s account if the user’s behavior violates the presents.



5. COPYRIGHT AND TRADEMARKS

Staffnight.ca and the other names, logos, icons, text, images, photographs and graphics that refer to products and services from Staffnight are protected by copyright laws and intellectual property right laws.

You are prohibited from modifying, copying, distributing, transmitting, reproducing, displaying, performing, publishing, licensing, transferring or selling any information, software, product or service obtained from the Site, nor creating material derived from the elements mentioned above.



6. REGISTRATION, USER NAME, PASSWORD

You are responsible for maintaining confidentiality of your username and password. You shall be responsible for all uses of the same, whether or not authorized by you, and you agree to immediately notify Staffnight of any unauthorized use of your username or password. Staffnight shall not be responsible for any loss or damage resulting from the non compliance with the security measure herein provided. We advise you, regarding this matter, to read attentively the clause of Limitation of Responsibility herein contained to take cognizance of the scope of your responsibility relating to the services provided by Staffnight.



7. LINKS

The Site may contain links to other sites or sources. Staffnight has no control in this regard and thus, cannot guarantee the availability accuracy, reliability of such sites or external sources. Staffnight neither guarantees nor approves the content to which such sites or sources give access and in no event will Staffnight be liable in any manner whatsoever for such site content.



8. CONTENT OWNERSHIP

You continue to hold copyright on all contents you submit to our service. By submitting or posting your content to or through the Site, you grant Staffnight a world-wide, royalty free, perpetual, irrevocable and non-exclusive license to use, reproduce, copy, in whole or in part, publish and display your content inside the Site.

Staffnight reserves the right to remove information from its network if the content is considered inappropriate or violates any provision herein contained.



9. GUARANTEES AND LIMITATION OF RESPONSIBILITY

The Site and its content are provided on an "as-is" and "as available" basis, without warranties of any kind, express or implied, including, but not limited to, implicit warranties of merchantability, fitness for a particular purpose, result and non-infringement. Under no circumstances, will Staffnight be liable for any special, indirect or consequential damages or any other damages resulting in loss of use, information or profits, whether due to negligence or a prejudicial action resulting from, or in relation with, the use or performance of information available on the Site.

Staffnight does not screen or censor the listings offered. As a result, Staffnight has no control over the quality, safety or legality of the jobs or resumes posted the truth or accuracy of the listings, the ability of the employers or recruiters to offer job opportunities to the candidates or the ability of the candidates to fill job openings. In addition, there may be risks, including but not limited to risk of physical harm of dealing with strangers, foreign nationals, underage persons or people acting under false pretences. You assume all risks associated with dealing with other users with whom you come in contact through the Site. Because user authentication on the Internet is difficult, Staffnight cannot and does not confirm that each user is who is claimed to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on the Site, in the event that you have a dispute with one or more users, you release Staffnight (and our agents and employees) from all claims, demands and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

You acknowledge and agree that you are solely responsible for the form, content and accuracy of any resume, posting or other content placed by you on the Site.

Staffnight shall not be responsible for any employment decisions, for whatever reason made, by any entity posting jobs on the Site.



10. INDEMNITY

You agree to defend, indemnify and hold harmless each of Staffnight, its affiliates, and each of their officers, directors, employees and agents, including all third parties mentioned at the Site, from and against any and all claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Site and the content or your breach of these terms of use.



11. APPLICABLE LAW

This agreement of conditions of service is governed by the laws of the province of Quebec. You hereby acknowledge that any disputes resulting from, or related to the use of the services and Site of Staffnight will be submitted to the competent jurisdiction in the district of Montreal, province of Quebec.
